Terms of Service & Payment Terms

By scheduling, requesting, or receiving services from JJ Handyman Co ("Company," "we," "us," or "our"), operated by Joey Kanive, you ("Client," "Customer," or "you") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and JJ Handyman Co. If you do not agree to these Terms, you may not use our services.

These Terms apply to all services performed by JJ Handyman Co in Dallas, TX and surrounding areas, whether arranged in person, by phone, by email, or through our website at www.jjhandymanco.com.

JJ Handyman Co provides residential and light commercial handyman services including but not limited to: plumbing, minor electrical (license-exempt fixture swaps only), pool maintenance (CPO certified), general repairs, carpentry, painting, and home improvement tasks.

Estimates & Proposals: All written estimates are valid for 30 days from the date of issue. Verbal estimates are good-faith approximations only and are not binding. Any estimate is based on the information available at the time of assessment. Changes to the scope of work may result in revised pricing.

Permits & Inspections: Client is responsible for obtaining all necessary building permits unless otherwise agreed upon in writing. JJ Handyman Co will advise when permits may be required but is not liable for unpermitted work requested by the Client. Permit fees, when applicable and pre-approved, will be billed to the Client at cost.

Subcontractors: We reserve the right to engage qualified subcontractors for specialty work. All subcontractors are vetted by JJ Handyman Co and held to our quality standards.

Deposit Requirements:

Accepted Payment Methods:

We accept cash, check (payable to "JJ Handyman Co"), Zelle, Venmo, and all major credit/debit cards. A 3% processing fee applies to credit card transactions.

Due Dates:

All invoices are due upon receipt unless otherwise specified in writing. Invoices not paid within 7 days of the due date are considered past due.

Late Fees:

Balances outstanding beyond 7 days from the invoice due date will accrue a late fee of 1.5% per month (18% annually) on the unpaid balance. JJ Handyman Co reserves the right to suspend ongoing work until overdue balances are paid in full.

Returned Checks:

A returned check fee of $35 will be charged for any check returned for insufficient funds. Client will be required to pay via cash or money order for all future transactions.

Collections:

In the event an account is referred to a collection agency or legal action is required to recover payment, Client agrees to pay all collection costs, attorney's fees, and court costs in addition to the outstanding balance.

Material Costs:

Materials purchased by JJ Handyman Co on the Client's behalf will be invoiced at cost plus a 15% procurement and handling fee. Client may elect to purchase materials directly, provided they are made available on the agreed start date. Delays caused by Client-supplied materials unavailability may result in rescheduling fees.

Client Cancellations:

Project Suspension by Client:

If a Client suspends work mid-project, Client will be invoiced for all labor performed to date, all materials ordered or purchased (including non-returnable items), plus a 15% project suspension administrative fee. Work will not resume until outstanding invoices are paid in full.

Company Cancellations:

In the rare event we must cancel, we will provide as much advance notice as possible and will work to reschedule at the earliest mutually convenient time. If we cancel with less than 24 hours' notice, we will honor the original quoted price with no additional charges.

JJ Handyman Co stands behind our work. We offer the following limited warranty on labor:

This warranty covers defects in workmanship under normal use and conditions. It does not cover:

Manufacturer Warranties: Parts and materials are subject to the manufacturer's warranty. We will assist in warranty claims where possible but are not responsible for manufacturer warranty fulfillment.

To exercise a warranty claim, contact us within the warranty period with a description of the issue. We will schedule a return visit at no charge for covered workmanship defects.

Maximum Liability: To the fullest extent permitted by applicable law, the total liability of JJ Handyman Co for any claim arising from services provided shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.

No Consequential Damages: JJ Handyman Co shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of use, or cost of substitute services, even if we have been advised of the possibility of such damages.

Pre-Existing Conditions: We are not responsible for pre-existing damage, defects, or code violations discovered during the course of work. We will notify Client of any such conditions discovered. If Client requests we proceed despite identified risks, Client assumes responsibility for any resulting issues.

Access & Property: Client is responsible for securing valuables and providing safe, clear access to the work area. JJ Handyman Co will exercise reasonable care but is not liable for incidental damage to property that could not reasonably be avoided during the normal course of the contracted work.

Insurance: JJ Handyman Co carries general liability insurance. A certificate of insurance is available upon written request.

To ensure efficient and safe service delivery, the Client agrees to:

Failure to meet these responsibilities may result in rescheduling, delays, or additional charges billed at our standard hourly rate.

Informal Resolution: In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. Client should contact us directly at (214) 293-8857 or jerrykanive@gmail.com within 30 days of the issue arising.

Mediation: If informal resolution fails, the parties agree to submit the dispute to non-binding mediation before a mutually agreed mediator in Dallas County, Texas, prior to pursuing litigation.

Governing Law & Venue: These Terms are governed by the laws of the State of Texas. Any legal action arising from these Terms or services provided shall be brought exclusively in the state or federal courts located in Dallas County, Texas.

Waiver of Class Action: Any dispute resolution proceedings will be conducted on an individual basis only; class action or consolidated proceedings are waived by both parties.

Time Limitation: Any claim or cause of action arising from services provided must be filed within one (1) year of the date the services were completed.

JJ Handyman Co reserves the right to photograph completed work for portfolio, marketing, and social media purposes. Photos will not include identifiable personal information without written consent. If you prefer that your project not be photographed, please notify us in writing before the start of work.

We reserve the right to update or modify these Terms at any time. Changes will be posted on our website at www.jjhandymanco.com with an updated "Last Modified" date. Continued use of our services following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
